Terms and conditions of sale
Document being finalised: the highlighted fields are to be completed before launch.
Version 1.0. Effective 3 October 2026. This is a translation of the French "Conditions générales de vente".
1. Seller
Products shown on notmydpt.com are sold by:
EVENT & SAFETY ENGINEERING ("ESE", "we", "us"), operating the NOT MY DPT brand
French SAS with a sole shareholder, share capital €1,000
Registered office: 15 rue des Halles, 75001 Paris, France
Paris RCS no. 951 249 937. EU VAT number: FR26951249937
Email: support@notmydpt.com. Phone: +33 1 84 80 80 69
2. Scope
These terms and conditions of sale (the "Terms") apply to any order placed on notmydpt.com by a consumer, meaning a natural person acting for purposes outside their trade, business or profession.
Businesses may order on the website. The Terms then apply to their order, except for the provisions that the law reserves for consumers (in particular the right of withdrawal and the legal guarantee of conformity). Volume orders are handled by quotation and specific terms.
To place an order you must be of legal age and have legal capacity, or have the permission of your legal representative.
The applicable Terms are those in force on the date of your order. You accept them by ticking the box provided before paying. They are sent to you with the order confirmation email.
The contract may be concluded in French or in English. The French version is the reference version. If there is any doubt about the meaning of a clause, the interpretation most favourable to the consumer prevails.
3. Products
The main characteristics of each product (reference, material and composition, dimensions or sizes, colour, printing technique) are shown on its product page.
Our products are made on demand. Your item is printed after you order, from a standard design in our catalogue. This does not deprive you of your right of withdrawal (section 8).
Photographs are as accurate as possible. Colour rendering depends on your screen: the shade of the printed product may differ slightly from the one displayed.
Our products are intended for adults. They are not designed for children under 14 and are not toys.
Offers are valid as long as the products are visible on the website.
4. Prices
Prices are shown in euros, all taxes included (VAT included at the rate applicable in the country of delivery). Shipping is included in the price, for all countries we deliver to: no shipping costs are added. The same price applies in all countries we deliver to.
The total amount payable is displayed before payment.
No additional charges will be claimed from you on delivery. If, exceptionally, a carrier were to claim import duties or taxes for a delivery within the European Union, we would bear them or refund them to you on presentation of proof.
We may change our prices at any time. The applicable price is the one displayed when you confirm your order.
5. Ordering
- You add products to your cart ("CASE").
- You check the contents of the cart. You can change quantities, remove an item or correct an error at any time before payment.
- You enter your contact details and delivery address.
- A summary shows the products, their main characteristics, the total price including taxes and shipping, and the delivery time.
- You accept the Terms, then confirm your order by clicking the payment button, whose label states unambiguously that the order creates an obligation to pay.
- The contract is concluded when you confirm your order and your payment is accepted. We acknowledge receipt by email without undue delay.
If you use express payment (Apple Pay, Google Pay) from a product page or from the cart, the same information is shown to you before you confirm the payment. A link to the Terms and to the information on the right of withdrawal is placed next to the button: by paying, you accept the Terms.
The confirmation email contains the order details, these Terms, the information on the right of withdrawal and the withdrawal form. Please keep it.
No account is required. A tracking link lets you view your order.
We may refuse or cancel an order for a legitimate reason: an unresolved previous payment dispute, serious suspicion of fraud, an obviously incorrect delivery address, or quantities that are abnormal for a consumer. You are then informed, and refunded if payment was taken.
Contracts of €120 or more are archived for ten years. You may access them on request to customer service.
6. Payment
Payment is made online, in euros, when you order, by bank card (CB, Visa, Mastercard, American Express), Apple Pay or Google Pay.
Payment is processed by our provider Stripe. Your bank may require strong authentication (3-D Secure). We never have access to your card details and do not store them.
The order is sent to production only once payment is accepted. Products remain our property until the price is paid in full.
The invoice for your order is sent to you by email or made available on your order tracking page.
7. Delivery
Where we deliver. We deliver to metropolitan France and to the European Union countries listed on the Shipping page.
Delivery times. The delivery time includes production time and transit time. We undertake to deliver no later than the maximum time shown on the Shipping page and repeated before payment. Where no time is stated, delivery takes place no later than 30 days after the order.
Multiple parcels. Our products are made in workshops specialised by product type. A single order may therefore arrive in several parcels, on different dates, at no extra cost to you.
Delay. If delivery has not taken place on the date or within the period announced, you may ask us to deliver within a reasonable additional period. If we fail to deliver within that new period, you may terminate the contract in writing. You may terminate it immediately if we refuse to deliver, or if the delivery date was an essential condition for you that you told us about before ordering. We then refund all sums paid, no later than 14 days after the date on which the contract was terminated.
Lost parcel. If your parcel has not arrived 15 working days after the dispatch notice, write to us. After checking with the carrier, we will send the product again or refund you, as you prefer.
Transfer of risk. The risk of loss of or damage to the product passes to you when you, or a third party designated by you other than the carrier, take physical possession of the product.
On receipt. Check your parcel when it arrives. If the parcel is damaged, an item is missing or the product is not the right one, write to us preferably within 14 days, with photos of the product and the packaging. This time frame helps us deal with your request quickly. It does not limit your rights under the legal guarantees.
Address. You are responsible for the accuracy of the delivery address. If a parcel cannot be delivered because of an incorrect or incomplete address that you entered, we contact you to agree on what happens next: a new shipment, at the actual cost which we tell you before any payment, or a refund of the product.
8. Right of withdrawal
You have 14 days to change your mind, without giving any reason. This right applies to all standard products in our catalogue, including when they are printed after you order.
Period. The period expires 14 days after the day on which you, or a third party designated by you other than the carrier, take physical possession of the product. If your order is delivered in several parcels, the period runs from receipt of the last product.
How to withdraw. You inform us of your decision by an unequivocal statement, by any of the following means:
- online, using the "Withdraw from contract here" function available at the bottom of every page of the website, on your order tracking page and in your confirmation email;
- by email to support@notmydpt.com;
- by post to the seller's address shown in section 1;
- using, if you wish, the model form reproduced in the appendix.
It is sufficient to send your statement before the period expires. If you use the online function, we send you without undue delay an acknowledgement of receipt by email, including the content of your statement and the date and time it was submitted.
Returning the product. In the acknowledgement of receipt of your withdrawal, we tell you whether the product must be sent back to us. We may waive this: you are then refunded without having to send anything back. If a return is requested, you send the product back without undue delay and no later than 14 days after informing us of your decision, to the following address: EVENT & SAFETY ENGINEERING (NOT MY DPT), 15 rue des Halles, 75001 Paris, France. Do not send anything to the sender address printed on the parcel: it is the workshop's address. You bear the direct cost of returning the product.
Refund. We refund all payments received from you for the products concerned, shipping included since it is part of the price, without undue delay and no later than 14 days after being informed of your decision. Where a return of the product is requested, we may withhold the refund until we have received the product or you have supplied evidence of having sent it back, whichever is the earliest. The refund is made using the means of payment you used for the order, at no cost to you.
Condition of the product. You may handle and try the product as you would in a shop. You are only liable for any diminished value of the product resulting from handling other than what is necessary to establish its nature, characteristics and functioning (for example: a garment worn, washed or stained, a sticker peeled from its backing).
Exception. The right of withdrawal does not apply to goods made to your specifications or clearly personalised (article L. 221-28, 3° of the French Consumer Code), for example a product bearing a text, name or image supplied by you. This exception does not concern standard catalogue products. Where a product is concerned, this is clearly stated on its product page and before payment.
Full information is available on the Withdrawal page.
9. Legal guarantees
We are liable for any lack of conformity of the products and for hidden defects, as provided by law. No commercial guarantee is offered in addition to the legal guarantees.
To make a claim, write to support@notmydpt.com with your order number, a description of the defect and photos. We will tell you how to proceed. The cost of returning a non-conforming product is borne by us.
The box below is a translation of the statutory information that French law requires in the French terms of sale.
The consumer has a period of two years from delivery of the goods to obtain implementation of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
Where the contract for the sale of the goods provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The legal guarantee of conformity requires the trader, where applicable, to provide all updates necessary to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without significant inconvenience to the consumer.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction of the purchase price while keeping the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, if:
1° The trader refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes significant inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request repair or replacement of the goods beforehand.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the restored goods are delivered.
The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs the implementation of the legal guarantee of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in exchange for returning the goods.
10. Liability
We are automatically liable to you for the proper performance of the contract, including where production and delivery are entrusted to our service providers.
We may be released from all or part of this liability by proving that the non-performance or poor performance is attributable to you, to the unforeseeable and insurmountable act of a third party to the contract, or to force majeure.
11. Intellectual property
The designs, slogans, visuals, texts and trade marks shown on the website and on the products are protected. Buying a product does not transfer any intellectual property rights. Any reproduction or commercial exploitation is prohibited without written permission.
12. Personal data
We process your data to manage your order, delivery, customer service and our legal obligations. Any phone number requested is used for delivery only: we do not make marketing calls. Details are set out in the privacy policy.
13. Customer service and complaints
For any question or complaint: support@notmydpt.com, or by post to the seller's address. Please quote your order number. We reply as soon as possible.
14. Consumer mediation
If your written complaint has not been resolved, you may refer the matter free of charge to a consumer mediator, within one year of that complaint:
CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), 49 rue de Ponthieu, 75008 Paris, France, www.cm2c.net.
If you live in another European Union Member State, you may also contact the European Consumer Centre in your country.
15. Governing law and jurisdiction
These Terms are governed by French law. If you live in another European Union Member State, you also benefit from the mandatory provisions of the law of your country of residence.
In the event of a dispute, you may bring proceedings, at your choice, before the courts of the place where you lived when the contract was concluded or when the harmful event occurred, or before any other court having jurisdiction under the law.
16. Extended producer responsibility identifiers
Pursuant to articles L. 541-10-13 and R. 541-173 of the French Environmental Code, ESE states the unique identifiers assigned to it for the extended producer responsibility schemes it belongs to:
- Clothing textiles (Refashion): unique identifier [TO COMPLETE: FR______]
- Household packaging ([TO COMPLETE: Citeo, Léko or Adelphe]): unique identifier [TO COMPLETE: FR______]
Appendix: model withdrawal form
